Article 1 Purpose
These Terms of Service are intended to define all matters related to the conditions of use and operation of the services of “815 Clinic” (hereinafter referred to as “815 Clinic”).
Article 2 Definitions of Terms
The definitions of major terms used in these Terms are as follows.
- Member: A person who agrees to the site’s terms, provides personal information, registers as a member, enters into a usage contract with the site, and uses the site’s services.
- Usage Contract: A contract entered into between the site and a member in relation to the use of the site.
- Member ID (hereinafter referred to as “ID”): A unique combination of letters and numbers assigned to each member for identification and use of the site’s services.
- Password: A combination of letters and numbers selected by the member to confirm that the member matches the assigned ID and to protect the member’s rights and interests.
- Operator: The operator who establishes and runs the website providing the service.
- Termination: The act of a member canceling the usage contract.
Article 3 Rules Outside These Terms
If necessary, the operator may separately announce operating policies. If these Terms and the operating policies overlap, the operating policies shall take precedence.
Article 4 Formation of Usage Contract
- The usage contract is formed when a person who wishes to register as a member and use the site agrees to the contents of these Terms and the operator accepts the membership application.
- A person wishing to register as a member and use the services expresses consent to these Terms by reading them and selecting “I agree” during the site registration process.
Article 5 Application for Service Use
- A person wishing to register as a member and use the site must provide all required information requested by the site (user ID, password, nickname, etc.).
- Members who do not register their true information, such as by stealing another person’s information or registering false information, may not claim any rights related to the use of the site and may be punished according to relevant laws.
Article 6 Personal Information Processing Policy
The site and the operator do not possess the passwords among the personal information provided at the time of membership registration, and related matters follow the site’s Privacy Policy. The operator strives to protect members’ personal information, including registration information, in accordance with relevant laws.
Matters related to the protection of members’ personal information follow relevant laws and the site’s Privacy Policy.
However, the operator bears no responsibility whatsoever for information exposed due to the member’s own fault. If a member registers or distributes illegal posts that harm public morals or national security, the operator may, upon request from relevant institutions, view the member’s data and submit such data to those institutions.
Article 7 Obligations of the Operator
- If the operator acknowledges that opinions or complaints raised by users are justified, the operator shall handle them as promptly as possible. However, if prompt handling is difficult due to personal circumstances, the operator will do its best by later notifying users or sending messages, emails, and similar communications.
- To provide a continuous and stable site, if facilities are damaged or lost, the operator may request the site to repair or restore them without delay. However, in cases of natural disasters or unavoidable circumstances affecting the site or operator, the site’s operation may be temporarily suspended.
Article 8 Obligations of Members
- Members must comply with matters stipulated in these Terms, all regulations set by the operator, notices, operating policies announced by the site, and relevant laws. Members must not engage in acts that interfere with the site’s business or damage the site’s reputation.
- Without the site’s explicit consent, members may not transfer or gift their service usage rights or contractual status to others, nor may they provide them as collateral.
- Users must exercise due care in managing their IDs and passwords and may not allow third parties to use their IDs without the consent of the operator or the site.
- Members must not infringe upon the intellectual property rights of the operator, the site, or third parties.
Article 9 Service Usage Time
- In principle, service usage is available 24 hours a day, 365 days a year, unless there are special business or technical issues. However, the site may temporarily suspend services on days or at times designated by the site for regular system inspections, expansions, or replacements. Planned service suspensions will be announced in advance on the site’s homepage, so please check regularly.
- However, the site may temporarily or permanently suspend services without prior notice or warning in the following cases.
- Urgent system inspections, expansions, replacements, failures, or malfunctions
- National emergencies, power outages, natural disasters, or other force majeure events
- Suspension of telecommunication services by carriers designated under the Telecommunications Business Act
- Service overload that interferes with normal service usage
- In cases of service suspension as described above, the site will notifyembers in advance through notices. However, if prior notice is impossible due to circumstancebeyond the site’s control, post-notification will be provided instead.
Article 10 Termination of Service Use
- If a member wishes to terminate the usage contract with the site, the member must personally submit a termination request online. Separately from site usage termination, termination of the usage contract with the site must also be completed.
- Upon submission of a termination request, programs related to the site provided by the site are automatically deleted from the member management screen, so the operator can no longer view the terminating member’s information.
Article 11 Restrictions on Service Use
Members must not engage in any of the following acts. If such acts are committed, the site may restrict the member’s service use, take lawful measures, terminate the usage contract, or suspend services for a specified period.
- Registering false information when signing up or updating information after registration
- Interfering with another person’s site usage or stealing information
- Impersonating site administrators, staff, or related persons
- Infringing upon the personal rights or intellectual property rights of the site or third parties, or interfering with business operations
- Illegally using another member’s ID
- Collecting, storing, or disclosing another member’s personal information without consent
- Acts objectively judged to be connected to crimes
- Other acts violating relevant laws
Article 12 Management of Posts
- The operator is responsible for managing and operating posts and materials on the site. The operator must always monitor for improper posts and materials. If improper posts or materials are discovered or reported, the operator must delete them and warn the member who registered them.
Members are responsible for the posts they upload. Members themselves must not post materials that violate these Terms. - If correction requests are made by public institutions such as the Korea Communications Ethics Commission, the operator may delete or move posts without prior consent from members.
- The criteria for judging improper posts are as follows.
- Content that seriously insults or damages the reputation of another member or a third party
- Content that violates public order and morals or links to such content
- Content that promotes illegal copying or hacking
- Advertisements for commercial purposes
- Content objectively recognized as being connected to crimes
- Content that infringes upon copyrights or other rights of other users or third parties
- Other content judged to violate relevant laws
- If the site or operator receives a request to suspend posting due to defamation, infringement of intellectual property rights, or similar claims from a third party, the site may temporarily suspend the posting (transmission suspension). If lawsuits, settlements, or decisions by relevant institutions occur between the requester and the poster and are submitted to the site, the site will follow those decisions.
Article 13 Retention of Posts
If the site operator is forced to suspend this site due to unavoidable circumstances, the operator will notify members in advance and strive to take all measures to make the transfer of posts easy.
Article 14 Copyright of Posts
- The copyright of posts uploaded by members on the site belongs to the posting member. The site may not use such posts for commercial purposes without the poster’s consent. However, this does not apply to non-profit purposes, and the site retains the right to post them within the service.
- Members may not commercially use materials posted on the service, such as by arbitrarily processing or selling information obtained through the service.
- If the operator judges that content posted or registered by members falls under any of the provisions of Article 12, the operator may delete, move, or refuse registration without prior notice.
Article 15 Damages
- All civil and criminal liabilities arising on this site primarily rest with the member.
- If damages suffered by a member from this site are caused by force majeure events such as natural disasters or by the member’s own intent or negligence, no compensation shall be provided.
Article 16 Disclaimer
- The operator is exempt from responsibility for members not obtaining expected benefits from the service or for damages arising from selection or use of service materials.
- The operator is exempt from responsibility for failures caused by the service infrastructure of this site or telecommunication services provided by other carriers. Damages arising in connection with this site’s service infrastructure are governed by the site’s Terms of Service.
- The operator bears no responsibility for materials stored, posted, or transmitted by members.
- The operator bears no responsibility for service usage disruptions caused by the member’s own fault.
- The operator bears no responsibility for all activities between members or between members and third parties, whether inside or outside the service (including data transmission and community activities).
- The operator bears no responsibility for the authenticity, reliability, or accuracy of materials posted or transmitted by members or any materials that members may receive through this site.
- The operator bears no responsibility for any damages arising from transactions between members or between members and third parties mediated through the service.
- The operator bears no responsibility for any disputes arising between members or between members and third parties without fault on the part of the operator.
- The operator bears no responsibility for damages suffered by members due to system failures that may occur without intent or gross negligence during server and facility management, inspection, maintenance, or replacement, attacks by third parties, distribution of computer viruses for which countermeasures have not been developed by well-known domestic or foreign research institutions or security firms, or other force majeure events beyond the operator’s control.
